TERMS OF SERVICE

Thank you for your choosing PhotoGuy.Com for your visual marketing services! The terms of our agreement are below. They govern our relationship and your use of our products.

SCHEDULING

  • Please contact me at least 24 hours before your preferred session time.
  • Appointment can be made online using the Booking page.

CANCELLATIONS

  • I understand that in real estate, as in life, plans frequently change. If a cancellation or rescheduling is necessary, I respectfully request a minimum of 24 hours notice before the beginning of your appointment. 
  • I may charge a cancellation fee of $50 with one of the following conditions occurs:
    • Cancelling within 24 hours before the beginning of your appointment.
    • No-show's.
    • Denied access to the property.
    • Property was not camera-ready. If the home is not camera-ready, I can shoot AS IS, or I can reschedule to the next available appointment. In the later case, I will have to charge a $50 cancellation fee to cover my travel costs and some of my time.

RESCHEDULING DUE TO WEATHER

  • If rain is present, I can shoot the interior as the seller has probably put a lot of hard work into preparing the property for the scheduled shoot (Tips For Awesome Property Images). I will then return for exterior photos at the earliest day possible when the weather cooperates.
  • Another option is I can reschedule the entire shoot to the next available appointment (no reschedule fees will be assessed for inclement weather).
  • Drones will not be flown in rain and/or wind above 10mph. These are not safe operations.

FAA DRONE AUTHORIZATIONS

  • Drone operations for videos or photos have to be authorized by the FAA by way of a Drone Authorization. Without this authorization, I can't provide these aerial images legally or safely.
  • One of the main reasons that the FAA denies approval of a drone operation is the property's close proximity to an airport. In this case, I can still provide walk-through videos and real estate photos without the aerial drone shots.

DURING THE PHOTO SESSION

  • Prior to or at the photo session, clients should outline important elements of the property or areas that should be highlighted, or areas or rooms that should not be photographed. Your input is important when choosing which rooms to photograph. Without your input I will use my best judgment, experience, and creativity to decide how to best photograph the property.
  • All properties will be shot "AS IS". I have a busy schedule and book appointments back-to-back so I don't have time to prepare (clean, move furniture, etc.) each listing for their images.
  • Owners or Agents are responsible for preparing the property prior to the photo session (Tips For Awesome Property Images). If requested, I can recommend some names and phone numbers of home cleaners, furniture movers, interior decorators or staging companies for the owner or agent to schedule. If the property is not camera-ready, I can return at my next available appointment, but this may incur a $50 cancellation fee. Please see Cancellations above.
  • During the shoot, I will work fast and the camera equipment (tripods and light stands) may produce a tripping hazard, so I request that foot-traffic be kept to a minimum.
  • Speaking of tripping hazards, please make sure pets are contained during the shoot. Pets are never included in photos and need to be out of the way during the shoot.

MILEAGE RATE

  • Outside of 30 miles from my studio location, I will charge a Mileage Rate to account for my travel costs. Travel from my studio to your listing or commercial property address is charged at $0.50 per mile, round-trip.
  • This mileage is determined by using Google Maps to route from my business address on my Contact page, to your listing address. This distance will then be doubled (rounded up) from my studio to get a round-trip number (e.g., 30 miles = 60 miles R/T = $0.50 x 60 = $30).

FULL-PAYMENTS

  • I accept all major credit cards (Visa, MasterCard, American Express, and Discover), cash and checks as forms of payment. Checks must first clear my bank before the images will be released.
  • Once clients have received an invoice (typically at the shoot or later that day), Full-Payment will be due.
  • Payments can be accomplished online on my secure Payments page by entering your credit card information.
  • Payments paid after my business hours, won't be processed until the following business day.

TURN-AROUND TIMES

  • 24 Hours: Images will be uploaded for review within 24 hours for MLS Photos. You will be notified via email and text that your images are ready for review.
  • 48 Hours: Walk-Through Videos will be uploaded for review within 48 hours. You will be notified via email and text that your images are ready for review.
  • After reviewing images, if the client approves the photos and has made their full payment, then a download button will be provided for downloading your images without watermarks, to your computer.
  • After reviewing images, if the client wants additional edits, or format changes, those requests need to be done within 48 hours. There may be an additional fee associated with these edits (reference Extras on my Pricing page). Any requested adjustments may require an additional 24 hours to process and re-upload the changes.

DELIVERABLES

  • All photos and/or videos will be provided via a secured website link.
  • Images will ONLY be provided to the client. Not to third parties such as the homeowner. Please see Rights and Usage Policies below.
  • Once full-payment has been received, I will provide a download button and all watermarks will automatically be removed from the images downloaded to your computer.
  • Photos and videos are fully optimized for the best balance between fast online loading and sharpness on MLS, Zillow, etc.
  • All of my website photos and videos are set to the same format that you will recieve from us, unless you specify otherwise. If your MLS or Printing Company have any specific requirements on the image formats, please provide these specifications before I format and upload images.
  • Image formatting to expect is as follows:
    • Photos: landscape mode, JPG format, resolution 720p (1280 x 720px), colorspace sRGB, no watermarks.
    • Videos: landscape mode, MP4 format, resolution 1080p (1920 x 1080px), colorspace sRGB, no watermarks, no branding except at the beginning and/or video ending (if requested).
      • MLS specifications: Same as above.
      • Zillow specifications: no copyright music, length less than 10 minutes, less than 500MB in size, no slideshows, and branding limited to a maximum of 15 seconds at the start and 15 seconds at the end of the video.

REPEAT VISITS AND REFUNDS

  • Any services that were paid for and weren't provided, will be refunded in full. For example, if I can't operate a drone due to listing's close proximity to an airport, then I will refund the full amount that you paid for that specific photo or video service.
  • My goal is always happy and ecstatic clients. If a customer is not happy with my work, I can offer 2 options:
    • Repeat Visit: Prior to or at the photo session, clients should outline important elements of the property or areas that should be highlighted, or areas or rooms that should not be photographed. Your input is important when choosing which rooms to photograph. Without your input I will use my best judgment, experience, and creativity to decide how to best photograph the property. So in the event of a repeat visit, I may charge the following additional fees:
      • Milage Rate ($0.50 Per Mile, Round-Trip) AND
      • Photos: Up To 5 Photos ($75) AND/OR
      • Videos: Up to 30 Seconds of additional footage ($200).
    • Refund: If I can't appease a client, then the only other option is to return their funds. In this case, the client needs to notify PhotoGuy.Com in writing within 7 days. If I do provide a refund, the client, the agent's parent company, and any third party are NOT authorized to use any of the photos and/or videos for print or online marketing. Unauthorized use of these photos and or videos will be treated as a Violation of Copyright.

RIGHTS AND USAGE POLICIES

  • All images produced for an agent or broker (hereafter referred to as agent) may be used by that agent for any and all marketing materials and campaigns associated with the property and for the agent’s self promotion.
  • The photos may also be used by the agent’s parent company for the sole purpose of marketing the specific property photographed for the duration of the listing, and must not be distributed to a third party without permission.
  • Also note that the images will be copyrighted by PhotoGuy.Com, and license granted only to the agent and the agent’s parent company and not to any third party such an the home owner.
  • Using any image as the base for another illustration or graphic content, including photography and/or videography, is a violation of copyright and intellectual property laws.
  • Any usage of the images by a third party, including but not limited to architects, builders, stagers, designers, sellers or buyers, is strictly prohibited unless approved in writing by PhotoGuy.Com
